1. Acceptance of Terms By accessing or using Mandala’s programs or programming ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Service Description Mandala offers cohort-based programs, and an AI-powered leadership development product that provides personalized insights and guidance. The product uses artificial intelligence models to process user inputs and generate responses.

3. User Eligibility and Account Requirements

  • Users must be 18 years or older
  • Users must have a valid Slack workspace account
  • Users must provide accurate information when interacting with the Service
  • Users are responsible for maintaining the confidentiality of their interactions

4. Acceptable Use Users agree not to:

  • Share sensitive personal, medical, or financial information
  • Use the Service for illegal purposes
  • Attempt to reverse engineer the Service
  • Share access with unauthorized users
  • Use the Service to generate harmful or malicious content
  • Upload viruses or malicious code

5. Intellectual Property

  • All content generated by the Service remains the property of Mandala for Us, Inc.
  • Users retain ownership of their input content
  • Users grant Mandala a limited license to process and store their inputs as outlined in the Privacy Policy

6. Service Availability and Modifications

  • The Service is provided "as is" and "as available"
  • We reserve the right to modify or discontinue the Service at any time
  • We may impose usage limits or restrictions without notice

7. Disclaimer of Warranties

  • The Service makes no warranties about the accuracy of AI-generated content
  • Users acknowledge that AI responses are probabilistic and may contain errors
  • The Service is not a substitute for professional advice (medical, legal, financial)

8. Limitation of Liability Mandala for Us, Inc. is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or business interruption
  • Damages resulting from user reliance on AI-generated content
  • Technical failures or service interruptions

9. Indemnification Users agree to indemnify Mandala for Us, Inc. against claims arising from:

  • Violation of these Terms
  • Misuse of the Service
  • Violation of third-party rights

10. Term and Termination

  • We reserve the right to terminate access for Terms violations
  • Users may terminate their use at any time
  • Upon termination, relevant sections of these Terms remain in effect

11. Changes to Terms

  • We may modify these Terms at any time
  • Continued use after changes constitutes acceptance
  • Users will be notified of significant changes

12. Data Processing & Compliance

  • Our collection and use of personal information in connection with your access to and use of the Services is described in our Privacy Policy.
  • If you are a business or organization subject to data protection laws and Mandala For Us, Inc. processes personal data on your behalf in the course of providing the Services, our Data Processing Addendum applies and is incorporated by reference into these Terms. By using the Services, you agree to the terms of the DPA.

13. Governing Law. These Terms are governed by the laws of Delaware, without regard to conflicts of law principles.

14. Dispute Resolution

  • Disputes will be resolved through arbitration
  • Users waive rights to class action lawsuits
  • Small claims court cases are exempt from arbitration

15. Health and Regulated Data Disclaimer

Mandala is not designed to process, and does not knowingly process, any data subject to specialized legal or regulatory protections, including but not limited to protected health information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA), payment card data governed by PCI DSS, or personal data of children under 13 under COPPA. You agree not to submit such data to the Services. If you do submit such data, you acknowledge that you do so at your own risk and Mandala disclaims any liability for the handling of such data under these laws.

16. No Emergency or Medical Use

Mandala's Services are not intended for use in situations where failure or delay of the Services could lead to personal injury, medical emergencies, or harm to users or others. The Services are not a substitute for professional mental health care, crisis intervention, or emergency services.

You agree not to rely on the Services for the detection, prevention, or management of mental health conditions or crises, including but not limited to self-harm, suicidal ideation, or harm to others. If you or someone else is experiencing a mental health crisis, please contact emergency services or a licensed professional immediately.

Mandala does not monitor communications for signs of harm or provide clinical or therapeutic oversight, and disclaims all liability for any harm or loss arising from reliance on the Services in inappropriate contexts
